CASL will take effect in July 2014, but more restrictions will be enforced on later dates.
Jan. 15, 2015, is the date set for unsolicited installation of computer programs and software to be prohibited. This part of the law is unique to Canada, as most other country’s anti-spamming legislation overlooks this aspect.
July 1, 2017, is the date set for the right of action. At that time, citizens will be allowed to take civil action against those marketers who have violated CASL and sent spam via text or email. By delaying this for a few years, the government is hoping to avoid excessive lawsuits and clogging of courtrooms against those organizations that are running behind schedule on updating their electronic messaging system.
